IMPORTANT NOTICE — READ BEFORE ENTERING

THIS IS A BINDING LEGAL AGREEMENT. A TICKET AND COMPLETED REGISTRATION ARE REQUIRED TO ENTER. THIS EVENT INVOLVES MOTOR VEHICLES THAT MOVE THROUGHOUT THE EVENT AREA, HIGH-PERFORMANCE VEHICLE DEMONSTRATIONS, EXTREME NOISE, EXHAUST AND FLAME, AND LARGE CROWDS. YOU COULD BE SERIOUSLY INJURED OR KILLED.
BY ENTERING THIS EVENT AND THESE PREMISES, YOU ASSUME ALL RISK OF INJURY, DEATH, AND PROPERTY DAMAGE, AND YOU GIVE UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. ENTER AT YOUR OWN RISK. NO ONE UNDER 18 MAY ENTER UNLESS REGISTERED BY A PARENT OR LEGAL GUARDIAN WHO ACCEPTS THESE TERMS ON THE MINOR'S BEHALF AND SUPERVISES THE MINOR AT ALL TIMES.

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF TIRE GROUP INTERNATIONAL, LLC AND THE OTHER RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM TIRE GROUP INTERNATIONAL, LLC AND THE OTHER RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND TIRE GROUP INTERNATIONAL, LLC AND THE OTHER RELEASED PARTIES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

  1. Agreement to These Terms
    These Attendee Terms and Conditions of Entry (this "Agreement") govern attendance at any Kool Kat Ambush event, at any date and location, hosted or co-hosted by Tire Group International, LLC d/b/a Cosmo Tires ("TGI") (each, an "Event"). "You" and "Attendee" mean any person who registers for, receives a ticket to, or enters an Event or the premises on which it is held, and include any minor for whom a parent or legal guardian has registered.
    "Released Parties" means TGI and its parent, subsidiaries, and affiliated companies, and each of their respective owners, officers, directors, members, managers, employees, agents, contractors, and volunteers; the owner, landlord, or lessor of the premises on which the Event is held; and the Event's sponsors.
    By registering for an Event, accepting these terms, receiving a ticket, or entering an Event or its premises, you agree to be bound by this Agreement. If you do not agree, do not register and do not enter.
  2. Entry Requirements and Ticketing

    Every person entering an Event must complete registration and accept this Agreement, and a parent or legal guardian must complete registration and accept this Agreement on behalf of any person under eighteen years of age. A valid ticket or credential must be presented at entry and displayed or retained while on the premises, and TGI may refuse entry to or remove any person without a valid ticket or credential.
    TGI may limit total attendance, close entry when capacity is reached, and refuse entry to or remove any person at its discretion, including for violation of this Agreement or of the rules of conduct set forth in Section 6. As a condition of entry, you consent to inspection of bags, containers, and other items you bring onto the premises; you may decline inspection, in which case you may be refused entry. Admission is free of charge unless otherwise stated for a particular Event, and no refund or other compensation is owed upon removal from an Event.
  3. Assumption of Risk

    You acknowledge that attending an outdoor automotive event involves inherent and other risks of personal injury, death, and property damage, including but not limited to the following:

    1. Motor vehicles operating, moving, entering, exiting, staging, repositioning, and being displayed throughout the Event area, in close proximity to attendees and pedestrians, and the risk of being struck by a vehicle;
    2. High-performance vehicle demonstrations and activities, including revving, two-step and anti-lag demonstrations, exhaust flame and backfire, engine and mechanical failure, fire, loss of vehicle control, and thrown or projected parts and debris;
    3. Extreme noise levels from vehicles, sound systems, and amplified music, which may cause temporary or permanent hearing damage;
    4. Exhaust fumes, carbon monoxide, smoke, tire smoke, fuel, and other vehicle emissions and fluids;
    5. Large crowds, crowd movement, crowd density, pushing, surging, and congestion;
    6. Walking surfaces at commercial, industrial, and warehouse properties, including uneven or cracked pavement, potholes, curbs, wheel stops, drainage grates, loading docks, ramps, cables, hoses, and other obstructions;
    7. Temporary structures and equipment, including tents, canopies, stages, barricades, ramps, inflatable structures, signage, and video screens, any of which may shift, collapse, or be displaced by wind;
    8. Electrical equipment, generators, and power cabling;
    9. Food and beverage vendors, including foodborne illness, allergens, hot surfaces, cooking equipment, and compressed gas;
    10. Flashing, strobing, and other lighting effects, which may affect persons with photosensitive conditions;
    11. The acts and omissions of other attendees, participants, vendors, sponsors, contractors, and third parties, including negligent, reckless, careless, intentional, or criminal conduct, assault, theft, and altercations;
    12. The presence or use of alcohol or other substances by other persons, notwithstanding TGI's prohibition on alcohol at Events;
    13. Weather and environmental conditions, including heat, humidity, sun exposure, dehydration, rain, wind, lightning, and storms;
    14. Vehicle and pedestrian traffic on public roadways adjacent to or surrounding the Event, and in and around parking areas; and
    15. Communicable and infectious disease.

    You voluntarily and knowingly accept and assume all such risks, whether known or unknown, and whether or not described above, and you accept full responsibility for your own safety and for the safety and supervision of any minor in your care.

  4. Release and Waiver of Claims

    To the fullest extent permitted by applicable law, you, on behalf of yourself and your heirs, executors, administrators, personal representatives, and assigns, hereby waive, release, discharge, and covenant not to sue the Released Parties from and against any and all claims, demands, causes of action, liabilities, damages, losses, costs, and expenses of any kind, whether known or unknown, arising out of or relating in any way to your registration for, attendance at, presence at, or departure from an Event or its premises, including any claim for personal injury, death, or damage to or loss of property.
    This release is intended to be as broad and inclusive as is permitted by applicable law, and is intended to apply to claims arising from the negligence of any of the Released Parties. It is your intention to fully assume all risk and to release the Released Parties to the maximum extent the law allows.
  5. Minor Children

    If you are registering a person under eighteen years of age, you represent that you are that person's parent or legal guardian and that you have full authority to accept this Agreement on that person's behalf.
    As the natural guardian of the minor, you waive and release, in advance, on behalf of the minor and on your own behalf, any claim or cause of action against the Released Parties which would accrue to the minor for personal injury, including death, and property damage resulting from an inherent risk in the activity, as authorized by section 744.301(3), Florida Statutes, and by any comparable provision of the law of the state in which the Event takes place.
    You agree to supervise the minor at all times while on the premises, to keep the minor with you and away from vehicles and vehicle movement areas, and to comply with, and ensure the minor complies with, the rules of conduct set forth in Section 6.
  6. Rules of Conduct

    While on the premises of an Event, you must follow all instructions and directions given by TGI staff, event personnel, security, and law enforcement; remain within designated spectator areas and behind any barriers; stay clear of vehicles, vehicle lanes, staging areas, and any area where vehicles are moving or being demonstrated; and supervise any minor in your care at all times.
    You must refrain from bringing or consuming alcohol, illegal drugs, or other intoxicants on the premises; from bringing weapons, firearms, fireworks, explosives, or other dangerous items onto the premises; from operating drones or other unmanned aircraft over or near the Event; from solicitation, unauthorized sales, and unauthorized commercial or promotional activity; and from any conduct that endangers, harasses, threatens, or interferes with any other person.
    TGI may remove you from an Event, without refund or other compensation, for any violation of these rules or for any conduct TGI determines to be unsafe or inappropriate.
  7. Emergency Medical Care

    You authorize TGI and event personnel to summon emergency medical services on your behalf, or on behalf of any minor in your care, if they determine in their discretion that it is appropriate to do so. You are solely responsible for the cost of any medical treatment, transport, or care provided. TGI does not represent that on-site medical personnel, first aid, or emergency medical services will be present at any Event, and undertakes no duty to provide them.
  8. Indemnification

    To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Released Parties from and against any claim, demand, liability, damage, loss, cost, or expense, including reasonable attorney's fees, arising out of or relating to your acts or omissions, your violation of this Agreement, or damage or injury you cause to any person or property at an Event.
  9. Photography, Video, and Likeness

    By entering an Event, you consent to being photographed, filmed, and recorded, and to the use of those images, video, audio, and of your name, voice, likeness, and vehicle for any purpose, in any medium, now known or later developed, without notice to you, without approval by you, and without compensation to you. You waive any right to inspect or approve any such use. This consent extends to any minor in your care for whom you have registered.
  10. Personal Property

    You are solely responsible for your personal property, including any vehicle you bring to or park at or near an Event. The Released Parties are not responsible for loss of, theft of, or damage to any personal property, and provide no security or safekeeping for it.
  11. Registration Information and Privacy

    TGI collects the information you provide at registration to administer Events, manage capacity and entry, and communicate with attendees about Events, and may use it for marketing purposes. TGI does not sell your personal information to third parties. TGI handles personal information collected in connection with registration consistent with applicable state and federal privacy and data breach notification law.
  12. Changes, Cancellation, and Force Majeur

    TGI may amend this Agreement at any time, and the version in effect at the time you register and enter governs your attendance at that Event. TGI may delay, suspend, relocate, modify, or cancel any Event, in whole or in part, at any time and for any reason, including weather, safety, capacity, or circumstances beyond TGI's reasonable control. TGI is not liable for any cost, expense, or loss you incur as a result.
  13. Governing Law and Venue

    The laws of the state in which the Event giving rise to the claim took place shall govern this Agreement and any dispute arising out of it, without regard to conflict-of-law principles. Venue for any dispute shall lie exclusively in the state or federal courts of the county in which that Event took place, and you consent to the personal jurisdiction of those courts.
  14. Severability and Interpretation

    Each provision of this Agreement is severable. If any provision, or any portion or application of any provision, is held invalid, void, or unenforceable, that provision shall be enforced to the greatest extent permitted by law, or if it cannot be so enforced, shall be severed, and the remainder of this Agreement shall remain in full force and effect. Nothing in this Agreement waives, releases, or limits any right or claim that cannot be waived, released, or limited as a matter of applicable law, and this Agreement shall be construed and applied so as to give it the maximum effect permitted by law.
  15. Entire Agreement

    This Agreement is the entire agreement between you and TGI concerning your attendance at an Event and supersedes all prior understandings on this subject. If you also register a vehicle for display at an Event, TGI's separate vehicle registration terms and conditions apply in addition to this Agreement.
  16. Acknowledgment

    By checking the acceptance box and completing registration, or by entering an Event or its premises, you confirm that you have read and understand this Agreement, that you are entering into it freely and voluntarily, and that you agree to be bound by it on behalf of yourself and any minor for whom you have registered.

  1. Aceptación de Estos Términos

  2. Requisitos de Entrada y Boletos

    Toda persona que entre a un Evento debe completar el registro y aceptar este Acuerdo, y un padre, madre o tutor legal debe completar el registro y aceptar este Acuerdo en nombre de cualquier persona menor de dieciocho años. Se debe presentar un boleto o credencial válido al entrar, y mantenerlo visible o en su poder mientras esté en las instalaciones, y TGI puede negar la entrada o retirar a cualquier persona sin boleto o credencial válido.
    TGI puede limitar la asistencia total, cerrar la entrada al alcanzar la capacidad máxima, y negar la entrada o retirar a cualquier persona a su discreción, incluso por violación de este Acuerdo o de las reglas de conducta establecidas en la Sección 6.     Usted reconoce que asistir a un evento automotriz al aire libre implica riesgos inherentes y de otro tipo de lesiones personales, muerte y daños a la propiedad, incluyendo, entre otros, los siguientes:

    1. Vehículos automotores que operan, circulan, entran, salen, se posicionan, se reubican y se exhiben por toda el área del Evento, en estrecha proximidad a asistentes y peatones, y el riesgo de ser atropellado por un vehículo;
    2. Demostraciones y actividades de vehículos de alto rendimiento, incluyendo aceleraciones en punto muerto, demostraciones de two-step y anti-lag, llamas y explosiones del escape, fallas mecánicas y del motor, incendio, pérdida de control del vehículo, y piezas o escombros proyectados;
    3. Niveles extremos de ruido provenientes de vehículos, sistemas de sonido y música amplificada, que pueden causar daño auditivo temporal o permanente;
    4. Gases de escape, monóxido de carbono, humo, humo de llantas, combustible y otras emisiones y fluidos vehiculares;
    5. Multitudes grandes, movimiento de multitudes, densidad de personas, empujones, avalanchas y congestión;
    6. Superficies para caminar en propiedades comerciales, industriales y de almacén, incluyendo pavimento irregular o agrietado, baches, banquetas, topes, rejillas de drenaje, andenes de carga, rampas, cables, mangueras y otras obstrucciones;
    7. Estructuras y equipos temporales, incluyendo carpas, toldos, escenarios, barricadas, rampas, estructuras inflables, señalización y pantallas de video, cualquiera de los cuales puede moverse, colapsar o ser desplazado por el viento;
    8. Equipo eléctrico, generadores y cableado eléctrico;
    9. Vendedores de alimentos y bebidas, incluyendo enfermedades transmitidas por alimentos, alérgenos, superficies calientes, equipo de cocina y gas comprimido;
    10. Luces intermitentes, estroboscópicas y otros efectos de iluminación, que pueden afectar a personas con condiciones fotosensibles;
    11. Los actos y omisiones de otros asistentes, participantes, vendedores, patrocinadores, contratistas y terceros, incluyendo conducta negligente, imprudente, descuidada, intencional o delictiva, agresiones, robo y altercados;
    12. La presencia o el uso de alcohol u otras sustancias por parte de otras personas, no obstante la prohibición de alcohol de TGI en los Eventos;
    13. Condiciones climáticas y ambientales, incluyendo calor, humedad, exposición al sol, deshidratación, lluvia, viento, relámpagos y tormentas;
    14. Tráfico vehicular y peatonal en las vías públicas adyacentes o circundantes al Evento, y dentro y alrededor de las áreas de estacionamiento; y
    15. Enfermedades transmisibles e infecciosas.

    Usted acepta y asume voluntaria y conscientemente todos estos riesgos, ya sean conocidos o desconocidos, y estén o no descritos anteriormente, y acepta plena responsabilidad por su propia seguridad y por la seguridad y supervisión de cualquier menor a su cargo.

  4. Liberación y Renuncia de Reclamaciones

    En la máxima medida permitida por la ley aplicable, usted, en su propio nombre y en el de sus herederos, albaceas, administradores, representantes personales y cesionarios, por medio del presente renuncia, libera, exonera y se compromete a no demandar a las Partes Liberadas por cualquier y toda reclamación, demanda, causa de acción, responsabilidad, daño, pérdida, costo y gasto de cualquier tipo, ya sea conocido o desconocido, que surja de o se relacione de cualquier manera con su registro, asistencia, presencia o salida de un Evento o sus instalaciones, incluyendo cualquier reclamación por lesión personal, muerte, o daño o pérdida de propiedad.

  5. Menores de Edad

    Si usted está registrando a una persona menor de dieciocho años, usted declara que es el padre, madre o tutor legal de esa persona y que tiene plena autoridad para aceptar este Acuerdo en nombre de esa persona.
    Como tutor natural del menor, usted renuncia y libera, por anticipado, en nombre del menor y en su propio nombre, cualquier reclamación o causa de acción contra las Partes Liberadas que pudiera corresponder al menor por lesión personal, incluida la muerte, y daño a la propiedad, que resulte de un riesgo inherente a la actividad, conforme a lo autorizado por la sección 744.301(3) de los Estatutos de Florida, y por cualquier disposición comparable de la ley del estado donde se lleve a cabo el Evento.

  6. Reglas de Conducta

    Usted debe abstenerse de traer o consumir alcohol, drogas ilegales u otras sustancias intoxicantes en las instalaciones; de traer armas, armas de fuego, fuegos artificiales, explosivos u otros artículos peligrosos a las instalaciones; de operar drones u otras aeronaves no tripuladas sobre o cerca del Evento; de solicitar, realizar ventas no autorizadas, y llevar a cabo actividad comercial o promocional no autorizada; y de cualquier conducta que ponga en peligro, acose, amenace o interfiera con cualquier otra persona.
    TGI puede retirarlo de un Evento, sin reembolso ni otra compensación, por cualquier violación de estas reglas o por cualquier conducta que TGI determine que es insegura o inapropiada.
  7. Atención Médica de Emergencia

    Usted autoriza a TGI y al personal del evento a solicitar servicios médicos de emergencia en su nombre, o en nombre de cualquier menor a su cargo, si determinan a su discreción que es apropiado hacerlo. Usted es el único responsable del costo de cualquier tratamiento médico, transporte o atención proporcionada. TGI no declara que habrá personal médico en el sitio, primeros auxilios o servicios médicos de emergencia presentes en ningún Evento, y no asume ninguna obligación de proporcionarlos.
  8. Indemnización

    En la máxima medida permitida por la ley aplicable, usted acepta indemnizar, defender y mantener libres de responsabilidad a las Partes Liberadas frente a cualquier reclamación, demanda, responsabilidad, daño, pérdida, costo o gasto, incluyendo honorarios razonables de abogados, que surja de o se relacione con sus actos u omisiones, su violación de este Acuerdo, o el daño o lesión que usted cause a cualquier persona o propiedad en un Evento.
  9. Fotografía, Video e Imagen

    Al entrar a un Evento, usted consiente ser fotografiado, filmado y grabado, y el uso de esas imágenes, video, audio, y de su nombre, voz, imagen y vehículo para cualquier propósito, en cualquier medio, conocido ahora o desarrollado en el futuro, sin previo aviso, sin su aprobación y sin compensación alguna. Usted renuncia a cualquier derecho de inspeccionar o aprobar dicho uso. Este consentimiento se extiende a cualquier menor a su cargo que usted haya registrado.
  10. Bienes Personales

    Usted es el único responsable de sus bienes personales, incluyendo cualquier vehículo que traiga o estacione en el Evento o cerca de este. Las Partes Liberadas no son responsables por la pérdida, robo o daño de ningún bien personal, y no proporcionan seguridad ni custodia de estos.
  11. Información de Registro y Privacidad

    TGI recopila la información que usted proporciona al registrarse para administrar los Eventos, gestionar la capacidad y la entrada, y comunicarse con los asistentes acerca de los Eventos, y puede utilizarla con fines de mercadeo. TGI no vende su información personal a terceros. TGI maneja la información personal recopilada en relación con el registro de conformidad con la ley estatal y federal aplicable en materia de privacidad y notificación de violaciones de datos.
  12. Cambios, Cancelación y Fuerza Mayor

    TGI puede modificar este Acuerdo en cualquier momento, y la versión vigente al momento de su registro y entrada rige su asistencia a ese Evento. TGI puede retrasar, suspender, reubicar, modificar o cancelar cualquier Evento, en su totalidad o en parte, en cualquier momento y por cualquier motivo, incluyendo el clima, la seguridad, la capacidad o circunstancias fuera del control razonable de TGI. TGI no es responsable por ningún costo, gasto o pérdida en que usted incurra como resultado.
  13. Ley Aplicable y Jurisdicción

    Las leyes del estado en el que se llevó a cabo el Evento que da origen a la reclamación regirán este Acuerdo y cualquier disputa que surja de él, sin considerar los principios de conflicto de leyes. La jurisdicción para cualquier disputa corresponderá exclusivamente a los tribunales estatales o federales del condado en el que se llevó a cabo dicho Evento, y usted consiente la jurisdicción personal de dichos tribunales.
  14. Divisibilidad e Interpretación

    Cada disposición de este Acuerdo es divisible. Si alguna disposición, o cualquier porción o aplicación de alguna disposición, se considera inválida, nula o inaplicable, dicha disposición se aplicará en la mayor medida permitida por la ley, o si no puede aplicarse así, será separada, y el resto de este Acuerdo permanecerá en pleno vigor y efecto. Nada en este Acuerdo renuncia, libera ni limita ningún derecho o reclamación que no pueda ser renunciado, liberado o limitado conforme a la ley aplicable, y este Acuerdo se interpretará y aplicará de manera que se le dé el máximo efecto permitido por la ley.
  15. Acuerdo Íntegro

    Este Acuerdo constituye el acuerdo íntegro entre usted y TGI respecto a su asistencia a un Evento y reemplaza todos los entendimientos previos sobre este tema. Si usted además registra un vehículo para exhibición en un Evento, los términos y condiciones de registro de vehículos de TGI aplican adicionalmente a este Acuerdo.
  16. Reconocimiento

    Al marcar la casilla de aceptación y completar el registro, o al entrar a un Evento o a sus instalaciones, usted confirma que ha leído y entendido este Acuerdo, que lo celebra libre y voluntariamente, y que acepta quedar obligado por él en su propio nombre y en nombre de cualquier menor que haya registrado.
